1. SWEEPSTAKES PERIOD. The Cutest Cookies Winter Giveaway ("SWEEPSTAKES") entry period begins on January 12, 2017 at 7:01 a.m. Eastern Standard Time (“EST”) and ends January 31, 2017 at 11:59 p.m. EST (“Sweepstakes Period”). By participating, each entrant agrees to these Official Rules of the Sweepstakes.
2. HOW TO ENTER. During the Sweepstakes Period, to enter without purchase or obligation, entrant must complete Sweepstakes form located on the Cutest Cookies Facebook Page (http://www.facebook.com/CutestCookiesNY) to be entered for a chance to win prizes. To be eligible, entry must be received by Sponsor during the Sweepstakes Period. Sponsor’s computer is the official clock for purposes of the Sweepstakes. All entries become property of the Sponsor and will not be returned. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. "Authorized Account Holder" means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address, and entrant may be requested to provide Sponsor with proof that he or she is the Authorized Account Holder. Proof of submitting an entry will not be deemed to be proof of receipt by Sponsor. Multiple entrants are not permitted to share the same e-mail address. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Any attempt by an entrant to obtain more than one (1) entry, by using multiple/different e-mail addresses or any other methods will void that entrant’s entries and that entrant may be disqualified. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by an entrant’s Internet service provider and/or email client or for insufficient space in entrant’s e-mail account to receive e-mail.
3. PRIZE/APPROXIMATE RETAIL VALUE. Three (3) Prizes will be awarded. Each prize will be in the form of a Cutest Cookies Gift Certificate. First place will be for a USD $100 Cutest Cookies Gift Certificate, Second place will be for a USD $75 Cutest Cookies Gift Certificate, and Third Place will be for a USD $50 Cutest Cookies Gift Certificate, for a total of USD $225 in Gift Certificates. Other prizes may be awarded at sponsor's discretion.
4. ELIGIBILITY RESTRICTIONS. Sweepstakes is offered and open only to legal residents of the 48 contiguous United Sates and the District of Columbia, at least 18 years of age or older at the time of entry. Employees of Cutest Cookies, their advertising and promotions agencies, and each of their respective immediate family members (spouse and parents, children and siblings and their spouses) and individuals living in the same households of such employees are ineligible. Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to these Official Rules and accept decisions of the Sponsor as final. The Sweepstakes is offered in the United States only and shall only be construed and evaluated according to United States law. Do not proceed in this site if you are not located in the United States.
5. ELIGIBILITY DETERMINATION. Prizes will be awarded only after eligibility has been determined. This shall include, but not be limited to, entrants satisfying all of the elements of the registration eligibility criteria after a review of documentation and determination of Sponsor in its sole discretion, such determination which shall be deemed final. In addition, entrants shall have fulfilled all of the conditions and accurately completed the documentation required herein, including as specifically set forth in Section 4 of these Official Rules.
6. AWARDING PRIZES. Winners will be randomly selected via a third party software. Potential winners will be contacted via email and will have 24 hours to respond in order to claim their prize. If prize goes unclaimed after 24 hours of initial notice, the prize will be awarded to an alternate winner. Unclaimed or undeliverable prizes will be forfeited and awarded to an alternate winner. Each winner will be announced on the Cutest Cookies Facebook page (http://www.facebook.com/CutestCookiesNY). Prizes can be picked up at any Cutest Cookies location, can be mailed to the winner, or provided as a one-time use discount code to be used on the Cutest Cookies website. Prizes are not transferable or redeemable for cash. Acceptance of prize constitutes permission (except where prohibited) to use winner's name, hometown and likeness for purposes of advertising, promotion and publicity in any media without additional compensation.
7. GENERAL CONDITIONS. Cutest Cookies reserves the right to substitute a prize of comparable or greater value in its sole discretion. Cutest Cookies also reserves the right to amend, suspend, or terminate Sweepstakes at any time. All entrants will also be added to Cutest Cookies email club and agrees to receive occasional marketing communications with the option to unsubscribe at any time.
8. LIMITATION OF LIABILITY: Cutest Cookies is not responsible for late, delayed, incomplete, unintelligible entries or entries not received by the entry deadline, interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware or software and other technical errors or failures of any kind, including any injury or damage to any person’s computer relating to or resulting from participating in or experiencing any materials in connection with the Sweepstakes, unauthorized human intervention, failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user’s ability to participate in the Sweepstakes. Cutest Cookies reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Cutest Cookies reserves the right to cancel or modify the Sweepstakes if fraud or technical failure compromises the integrity of the Sweepstakes or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by Cutest Cookies in its sole discretion. Released Parties shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the prize, the receipt, use, misuse and/or enjoyment of the prize. This Sweepstakes offer is being made exclusively by Cutest Cookies.
9. WINNER’S NAMES AND RULES. For a winner list, send a self-addressed envelope to Cutest Cookies at 1300 Hylan Blvd., Staten Island, NY 10305 after February 7, 2017. Requests for a copy of the rules may be made by sending a self-addressed envelope to the Cutest Cookies at the address above. All rules requests must be received by January 20, 2017.
10. PRIVACY. All information submitted by entrants in the Sweepstakes will be treated according to Cutest Cookies Privacy Policy, and will never be shared with any outside vendors or partners.
